Annual Maintenance and Support Fees
Annual Docket Fee Due
Indiana State law (IC 33-19-6-5) requires that the Clerk collect a yearly service fee in the county where the Court's support or maintenance order is made. This fee is required in addition to regular support and maintenance payments. Since January 1, 1998, the fee has been ordered as follows:
- Twenty dollars ($20.00) for the calendar year in which the initial order is entered, unless the first payment is due after June 30 of that calendar year;
- Ten dollars ($10.00) for the calendar year in which the initial order was entered, if the first payment is due after June 30 of that calendar year; and
- In each subsequent year in which the initial order or a modified order is in effect, twenty dollars ($20.00) if the fee is paid before February 1, or thirty dollars ($30.00) if paid after January 31.
A personal check made payable to the Clerk of the Circuit Court may be used to pay the service fee. The Clerk cannot deduct the docket fee from a child support payment. Please include” Support Service Fee," court case number, your name, and the recipient's name on the payment. All persons ordered to pay support must pay the fee. The law does not specify exceptions based on whether payments are made directly to the recipient, or through the Clerk's Office.
